Principles 1-Application Principles
The
private persons who reside outside the Turkish Customs Territory or the legal
persons who have a registered address of employment in this territory can bring
vehicles.
3- The
Occasions to Prepare the Vehicle Entrance and Exit Form
Vehicle Entrance and Exit form is issued by Customs Administration
according to the annex 55 which is stated in Customs Regulations for the
vehicles which is taken to Turkish Customs Territory and having the conditions
mentioned in the article 20 of Decree of Councils of Ministers dated 05.02.2000
numbered 2000/69 and special conditions.
Moreover, in order to be
issued Vehicle Entrance and Exit Form; the following documents must be
produced.
On condition that the vehicles
brought to Turkish Customs Territory with regard to the Highway Traffic Law and
Traffic regulations do not have the insurance valid in Turkey, the obligatory
traffic insurance policy issuing of which is necessary for the period in which
will stay in Turkish Customs Territory.
The motorized vehicle Registration
Certificate given by the traffic, municipality or other competent Foundations of
the state to which the vehicle is registered, indicating the owner of the
vehicle, the numbers of engine, chassis and number plate and the other
qualifications or the ownership certificate having these
conditions.
4- The Vehicles Which Will Be Permitted to Enter by Issuing a
Vehicle Entrance and Exit Form:
Every kind of private land vehicles including the caravans and the
trailers, which can be used with motorized vehicles, are permitted to
enter.
5- The Use of the Vehicles in Turkey, That Entered by the Vehicle
Entrance and Exit Form:
The land vehicles permitted to enter to Turkey in this aspect can be used
exclusively for private and non-commercial
purposes. A
commitment is taken from the persons who bring private road vehicles by
arranging a Vehicle Entrance and Exit Form containing their legal rights and
indicating the sanctions when they violate these
rights.
7- The Time Limit for the Private Land Vehicles to Stay in Turkey:
If the private land vehicles are brought to Turkey the time limit for the
vehicle stay in the Turkish Customs territory is determined by Customs
Administrations by considering the aim of bringing and declared documents of the
applicant.
a) The time limit for the private land vehicle that will be used by the
person between his or her current residence and his present occupational
residence is determined by consideration of the persons declaration and his or
her certificates.
b) The time limit for the private land vehicle registered in the
residence of the students who come to Turkey for education is determined by
considering the residence period in Turkey,
c) The permission for the private land vehicle of a person who comes for
a specific assignment to Turkey is determined according to his duration of
residence in Turkey. The private land vehicle that has entered in the framework
of vehicle entrance and exit form can be used by the spouse or his or her
children or by his or her driver who have their residence out of
Turkey.
d) For the land vehicles restricted to private use, that will be brought
by the person established in Turkish Customs Territory by way of renting or
borrowing abroad, the permitted time limit is 15
days.
e) The real person who are about to transport their residence from
Turkish Customs Territory to out of this territory has to take his or her
private land vehicles, which were registered to them out of the Turkish Customs
Territory, within the 3 months after the transporting of his or her
residence.
f) For the vehicles of Turkish citizens who have retired or filled the
time limit to earn the right for retirement in the country of residence,
one-year period is permitted according to their
demand.
It is necessary to declare their conditions and documents approved by the
consulate.
g) Except from the reasons mentioned above, the private land vehicles
(registered out of the Turkish Customs Territory) of the person who comes to
Turkey for any purpose can be used for 6 months continuously or non-continuously
in a period of 12 months. However, this period cannot exceed 24 months from the
date of issuing of the form in any circumstances.
8- Extension of the
Time Limit
It is necessary to apply to any Customs Administration for extension of
the time limit and present the extension applications with the documents
requiring the extension for the periods registered in the Vehicle Entrance and
Exit Form.
The Customs Administration realizes the extension on the same form when
it determines the convenience of the produced
documents.
However, the extension can never
exceed 24 months from the date of issuing of the
forms.
9- The
Violation of the Conditions Mentioned in the
Commitment.
a) According to the Article 238 of
the Customs Law numbered 4458, if the vehicles brought in the Turkish Customs
Territory by Vehicle Entrance and Exit Form are used out of its bringing
purpose; and which are rented or lent to another person, do not exit the Turkish
Customs Territory despite the expiry of the time limit or are not submitted to
Customs Administration or transferred to a person who does not have the right to
use; sold; or changed in parts without permission; the customs taxes may be
collected. Moreover, a penalty twice the collected tax will be paid and the
vehicle will be submitted to the Customs Administration to be taken out of the
Turkish Customs Territory.
Following the collection of the fine, the vehicle is allowed to be taken
out of the Turkish Customs Territory in accordance with the provision of transit
regime. For the vehicles which are abandoned to Customs in the condition of
“Absolute Abandonment” after the violation of conditions, the same procedures
are applied besides the provision of destruction will be
applied.
b) According to the first paragraph of the article 241 Customs Code,
numbered 4458; if the vehicle stamp is not attached to the front windshield
of the vehicle or the form is not produced when asked, or the form is not
presented in the vehicle, 30.000.000 TL of penalty will be
applied. 10. The Procedures Which Will Be Applied For Stolen Vehicles. If the parts or the whole of the vehicle
which is taken to the Turkish Customs Territory in the cover of the Vehicle
Entrance and Exit Form, are stolen, while they are in the Turkish Customs
territory, the erasement of the registration of the vehicle is requested from
Customs Administration by applying with the document certifying the act of
stealing taken from Public Prosecutor. If the Customs Administrations certifies
the presented documents, it will erase the related
registration. However, according to the article 238 of
Customs Code, if the car is stolen after its legal time limit has elapsed, the
customs tax of the vehicle may be collected, moreover a penalty amount of twice
as the tax is collected.

The Procedures Which Will Be Applied To the Vehicles Damaged by
Accident. The
vehicles which are needed to be sent abroad for maintenance or which are
determined as “damaged” by Customs Administration due to an accident, must be
submitted to a mechanic approved by the Customs Administration with a written
report. After the
repair of the vehicle, the Customs Administration gives permission for the
vehicle to be taken into a warehouse for re-export.
12- Transfer of the Vehicle to Another Person Transfer of
a vehicle to a foreign person who has the same right is possible for the
vehicles which are brought in Turkey with a vehicle entrance-exit form and
submitted during custom control is appropriate to the written commitment which
is taken during the entrance. Customs
administrations have the authority for carry out the transfer procedure which is
operated by arranging new vehicle entrance-exit form, based on the document
certified by the related consulates, in the name of the purchaser.
13-
Closure to the Vehicle Registrations Although a vehicle which is brought in Turkey by arranging a vehicle entrance-exit form and taken out of Turkey in the permitted time limit; the owners of the vehicle who still have the vehicle registration on their passport records should apply to any custom offices to erase this registry from their passports; the related custom office investigates the situation and if they determine that the vehicle is taken out of Turkey, they erase the registry from the passport.
